1. Scope
This policy applies to messages, audio files, videos, images, campaign creatives, and other content submitted, stored, or displayed through To Donate. Users must only submit content they are entitled to use and that does not infringe copyright, related rights, trademarks, image rights, or other applicable rules.
2. How to report
Send a notice to support@todonate.me with the subject “Copyright — notice”. For the DSA Article 16 mechanism, include: your name and electronic contact; identification of the work or right; the exact electronic location of the content; a substantiated explanation of the alleged illegality; and a good-faith statement that the information is accurate. For a DMCA notice under 17 U.S.C. § 512, also include your address and phone number, physical or electronic signature, a good-faith statement that the use is not authorised by the owner, agent, or law, and a statement under penalty of perjury that the information is accurate and that you are authorised to act for the owner of the exclusive right.
3. Review and action
We confirm receipt when a notice includes electronic contact information and review it in a timely, diligent, objective, and non-arbitrary manner. We may remove or restrict access, request clarification, or take no action where a notice is insufficient or manifestly unfounded. We communicate the decision, reasons, and available redress to the notifier and affected user. When we receive a valid DMCA counter-notice, we forward it to the original notifier and may restore the content between 10 and 14 business days later unless we receive evidence of a court action seeking to prevent restoration.
4. Counter-notice
If content is removed or restricted, the affected user may request DSA review with the content identification, reasons, and relevant evidence. A DMCA counter-notice must include: a physical or electronic signature; identification and former location of the material; a statement under penalty of perjury that the user has a good-faith belief that removal resulted from mistake or misidentification; name, address, and phone number; consent to the jurisdiction of the competent United States federal court or, if outside the United States, the jurisdiction where the provider is located; and acceptance of service from the original notifier or their agent.
